General Terms and Conditions
Important Information Concerning Tournament and Service Bookings
Separate General Terms and Conditions apply to every tournament
registration and every booking made through our website. These contain
binding provisions concerning:
- Withdrawal and cancellation conditions
- Payment terms
- Provisions concerning force majeure, such as severe weather,
pandemics or official regulations
- Exclusion of liability for cancellations beyond our control
By submitting a binding registration through the booking form or by
email, you automatically accept our General Terms and Conditions.
Liability in Cases of Force Majeure
If events have to be cancelled for reasons beyond our control, such as
severe weather, official requirements, pandemics or political events,
there is no entitlement to the event taking place or to compensation.
Payments already made will be refunded or credited in accordance with
the applicable General Terms and Conditions.
You will receive the binding General Terms and Conditions for review
before booking and must actively confirm your acceptance.
Formation of the Contract
A contract with the organiser is formed when a booking is made either
through the organiser’s online platform or directly by email. For online
bookings, the contract is formed when the organiser’s online system
automatically confirms the booking. For bookings made by email, the
contract is formed when the organiser sends the confirmation and
invoice. This applies both to standard offers and to services
individually tailored by the organiser.
In the case of a group event, where one responsible person registers a
group of participants, the organiser enters into the contract with the
person making the booking on behalf of the party responsible for payment
and for the group. This booking is also binding. In this case, the
person making the booking is entitled to replace individual
participants, provided that the organiser does not have an important
reason for rejecting the replacement. The person making the booking
undertakes to make these General Terms and Conditions available to the
participants for whom the booking was made immediately after the
contract has been concluded.
The organiser reserves the right to cancel or withdraw from the event up
to one week before its scheduled start after exhausting all other
options if holding the event would be unreasonable because the number of
bookings is so low that the costs incurred by the organiser would exceed
the economically acceptable limit. The organiser may only exercise this
right of withdrawal if the circumstances leading to the withdrawal can
be demonstrated and the participant or person responsible for the
booking has been offered a comparable replacement event. If the
replacement offer is accepted, any participation fee already paid will
be credited towards the participation fee for the replacement event.
Otherwise, any participation fee already paid must be refunded promptly
by the organiser.
Contract Term
The contract begins and ends at the times agreed in each individual
case.
The fee for the event is based on the organiser’s current price at the
time the contract is concluded.
The participant or the person responsible for booking on behalf of a
group may pay the fee by bank transfer.
Upon conclusion of the contract, a deposit amounting to xxxxxxxxxxxxx%
of the total price becomes due. The remaining amount must be paid no
later than xxxxxxxxxxxx weeks before the planned start of the event.
Scope of Services
The scope of services is determined by the event descriptions on this
website and, additionally or alternatively, by an individual service
description provided by the organiser. Individual service descriptions
provided by the organiser supplement the service description on the
website if the participant or the person responsible for booking on
behalf of a group adds services to the offer displayed on the website.
In the case of a completely individual booking, the individual service
description replaces the offer description on the website.
If participants do not make use of individual services included in an
event, the organiser reserves the right to charge the full participation
fee because the event is calculated as an overall package.
Exclusion of a Participant
A participant may be excluded from further participation in an event for
behavioural reasons. Such reasons generally apply if, despite a prior
warning that may be issued verbally, in writing or in text form, the
participant’s conduct persistently disrupts the event or seriously
violates accepted standards of morality and/or the sense of decency of
other participants.
Participants undertake not to be under the influence of alcohol or other
intoxicating substances that could impair their reactions while
participating in the event.
If a participant is excluded from the event, the organiser reserves the
right to charge the participation fee without deductions. The
participant retains the right to prove that the organiser incurred lower
expenses.
Cancellation by the Participant or the Person Responsible for the Booking
A cancellation is only effective if it is submitted in writing or text
form before the start of the event. It may be submitted by email. The
cancellation must be submitted by the participant or, in the case of a
group booking, by the person responsible for making the booking.
Cancellation up to xxxxxxxxxx weeks before the start of the event is
free of charge.
In the event of cancellation less than xxxxxxxxxxx weeks but more than
xxxxxxxxxx weeks before the start of the event, the organiser reserves
the right to claim xxxxxxxxxxx% of the total gross event fee.
In the event of cancellation from xxxxxxxx weeks before the start of the
event, the organiser reserves the right to claim xxxxxxxxxxx% of the
total gross event fee.
If a participant fails to attend the event without having cancelled
beforehand, the organiser reserves the right to claim the full gross
event fee.
Cancellation is also free of charge if a replacement participant is
registered no later than xxxxxxxxxx weeks before the start of the event
and there are no grounds for excluding that person pursuant to Section
IV. A replacement participant cannot be registered after the event has
begun.
The participant or the person responsible for the booking retains the
right to prove that no costs, or substantially lower costs than the
previously agreed fee or proportion of the fee, were incurred in
connection with the cancellation or non-attendance.
Photography and Video Recordings
For advertising purposes, the organiser is entitled to take photographs
and video recordings throughout the event and subsequently use them
commercially for an unlimited period.
Liability
The organiser is liable in cases of intent or gross negligence in
accordance with statutory provisions. Liability for any guarantees given
applies irrespective of fault.
In cases of ordinary negligence, the organiser is liable exclusively in
accordance with the provisions of the German Product Liability Act, in
cases of injury to life, limb or health, or in cases involving a breach
of essential contractual obligations.
Compensation for an ordinarily negligent breach of essential contractual
obligations is limited to foreseeable damage typical of the contract,
except where liability applies due to injury to life, limb or health.
The organiser is liable for the fault of its agents and representatives
to the same extent.
The above provisions apply to compensation in addition to performance
and to claims for reimbursement of wasted expenditure, irrespective of
their legal basis, including liability arising from defects, delay or
impossibility.
Final Provisions and Place of Jurisdiction
If any provision of the contract is or becomes invalid, incomplete or
unenforceable, the validity of the remaining provisions shall remain
unaffected.
In place of the invalid, incomplete or unenforceable provision, the
parties undertake to agree upon a provision that, taking the statutory
requirements into account, comes closest to the parties’ actual or
presumed intention.
To the extent permitted by law, the parties agree that Stuttgart,
Germany, shall be the place of jurisdiction for all disputes arising
from or in connection with this contract or concerning its existence.
Arbitration Proceedings
The organiser does not participate in arbitration proceedings.
Priority of Individual Agreements
Individual agreements between the parties take precedence over these
General Terms and Conditions but must be made in writing.
